What Constitutes Medical Malpractice?
Medical malpractice cases can be complicated and highly technical. But they can also be worth every cent and every minute spent pursuing them when it means patients who are injured by a medical mistake receive the compensation they deserve.
However, just because a physician or other healthcare professional makes an error, it does not automatically mean there has been an incident of medical malpractice.
Medical malpractice, or medical negligence as it is sometimes called, occurs when a healthcare professional, such as a doctor, nurse, surgeon or EMT, is careless in providing care or fails to act when treating a patient, and the outcome is injury to the patient.
Typically, to determine that an act of medical malpractice has taken place, experts will be asked to provide their professional opinions about what the appropriate standard of care would have been in that situation.
In addition, a patient's injury must be more than trivial harm. (Medical malpractice, of course, can also mean a consequence of wrongful death.)
